A sitting member of the U.S. House of Representatives is facing serious federal charges.

The stunning development comes after an incident at an immigration facility.

Serious Accusations Leveled

The Justice Department has announced charges against Rep. LaMonica McIver, a Democrat representing New Jersey.

She stands accused of “assaulting, impeding and interfering with law enforcement” officials.

The charges stem from an incident earlier this month at an Immigration and Customs Enforcement (ICE) facility in Newark, New Jersey.

The announcement was made by the acting U.S. attorney for New Jersey, Alina Habba.

Deputy Attorney General Todd Blanche publicly backed Habba’s statement.

“assaults on federal law enforcement will not be tolerated.”

Blanche emphasized the seriousness of the accusation.

Incident at the ICE Facility

The incident occurred on May 9th at Delaney Hall, an ICE detention center.

Rep. McIver was present with two other House Democrats.

They stated they were there to conduct federal oversight.

Their visit coincided with a protest outside the facility.

During the chaotic scene, Newark Mayor Ras Baraka was arrested on trespassing charges.

Those charges against Mayor Baraka have since been dropped by the U.S. Attorney’s office.

Habba stated this was done “for the sake of moving forward.”

Conflicting Accounts Emerge

What transpired inside the facility is subject to vastly different descriptions.

Homeland Security officials provided their perspective on the events.

Assistant Homeland Security Secretary Tricia McLaughlin accused the lawmakers of “storming into” the facility.

“Members of Congress are not above the law and cannot illegally break into detention facilities,” McLaughlin said.

Homeland Security Secretary Kristi Noem also weighed in.

Noem stated that a review of video footage and an investigation by her department supported the charge against Rep. McIver.

Congresswoman Denies Accusations

Rep. McIver has strongly denied the allegations.

In a statement, she called the charges “purely political.”

She maintains she was fulfilling her lawful oversight duties.

McIver claims ICE agents “created an unnecessary and unsafe confrontation” by arresting Mayor Baraka.

Her lawyer, Paul Fishman, echoed this defense.

“She went to Delaney Hall to do her job. As a member of Congress, she has the right and responsibility to see how ICE is treating detainees.
Rather than facilitating that inspection, ICE agents chose to escalate what should have been a peaceful situation into chaos. This prosecution is an attempt to shift the blame for ICE’s behavior to Congresswoman McIver,” Fishman stated.

Fishman characterized the decision to charge McIver as “spectacularly inappropriate.”

Rep. Rob Menendez, who was present with McIver, also accused ICE agents of physical contact.

He alleged agents put “their hands” on McIver and Rep. Bonnie Watson Coleman.

Political Firestorm Ignites

House Democratic leaders quickly condemned the charges.

In a joint statement, they called the prosecution “morally bankrupt.”

They claimed the charges lacked “any basis in law or in fact.”

“By visiting the detention center in Newark, Rep. McIver and two other Members of Congress were upholding their oath of office. They didn’t assault anyone, but were themselves aggressively mistreated by illegally masked individuals,” the statement read.

The leaders, including Hakeem Jeffries, Katherine Clark, Pete Aguilar, Ted Lieu, and Joe Negeuse, framed the charge as politically motivated.

“The proceeding initiated by the so-called U.S. Attorney in New Jersey is a blatant attempt by the Trump administration to intimidate Congress and interfere with our ability to serve as a check and balance on an out-of-control executive branch,” they asserted.

The Democrats vowed to “respond vigorously” to the situation.

Federal prosecutors have frequently used assault charges against those who clashed with law enforcement during the U.S. Capitol incident on January 6, 2021.

The Justice Department has also recently pursued cases against individuals critical of President Trump or involved in legal challenges against him.

The charging of a sitting Congresswoman with assaulting federal agents marks a significant escalation in the ongoing political and legal clashes surrounding immigration enforcement and oversight.

The case is expected to move forward in court as Rep. McIver stated she looks forward to the truth being revealed there.
