Democrat Congresswoman faces prison after alleged assault at ICE facility

A sitting U.S. Representative is facing serious federal charges.

The allegations stem from a heated confrontation outside a New Jersey immigration facility.

Incident Outside Delaney Hall

The situation unfolded earlier this month at Delaney Hall, a facility in Newark used for ICE detainees.

A group of protesters had gathered, and among them were several elected officials, including Representative LaMonica McIver and Newark Mayor Ras Baraka.

The confrontation reportedly escalated when the gates opened to allow an ICE vehicle to enter.

According to officials from the Department of Homeland Security (DHS), four officials, including Rep. McIver and Mayor Baraka, allegedly rushed through the gates past security personnel.

DHS Assistant Secretary Tricia McLaughlin commented on the incident, stating that attempting to “storm into a detention facility” would typically result in arrest for any citizen.

She added,

“Just because you are a member of Congress or just because you’re a public official, does not mean you are above the law.”

Federal Charges Filed

Acting U.S. Attorney for the District of New Jersey, Alina Habba, announced the charges against Rep. McIver.

In a letter shared publicly, Habba stated that McIver was charged with “assaulted, impeded, and interfered with law enforcement in violation of Title 18, United States Code, Section 111 (a)(1).”

The U.S. Attorney emphasized the seriousness of the alleged conduct.

“That conduct cannot be overlooked by the chief federal law enforcement official in the State of New Jersey, and it is my Constitutional obligation to ensure that our federal law enforcement is protected when executing their duties,” Habba’s letter read.

Notably, the trespassing charge against Mayor Ras Baraka, who was also arrested during the incident, was dismissed by the U.S. Attorney’s office after “extensive consideration.”

No One Is Above The Law

The Department of Homeland Security has strongly supported the decision to prosecute.

DHS Secretary Kristi Noem issued a statement reinforcing the principle of equal application of the law.

“If any person, regardless of political party, influence or status, assaults a law enforcement officer as we witnessed Congresswoman McIver do, you will be prosecuted to the fullest extent of the law,” Secretary Noem stated.

She also expressed gratitude to the ICE law enforcement officers involved, thanking them for their service.

Congresswoman Responds to Charges

Representative McIver has publicly pushed back against the charges.

In a statement, she claimed she and her colleagues were attempting to fulfill “lawful oversight responsibilities” at the facility.

She characterized the charges against her as “purely political” and alleged they “mischaracterize and distort my actions.”

McIver stated that ICE agents “created an unnecessary and unsafe confrontation” when they arrested Mayor Baraka.

Mayor Baraka, while pleased with the dismissal of his own charge, also offered support for McIver, stating he expects her to be “vindicated.”

Facing Potential Prison Time

The charges are not minor.

Prosecutors have indicated that Representative McIver faces several felony charges related to the alleged assault and impedance of federal officers.

This means that if convicted, she could be looking at potential time behind bars.

Sources close to the case indicate that McIver is expected to turn herself in soon, though the specifics will be determined by the magistrate.

Background on Delaney Hall

Delaney Hall is a privately operated facility managed by the GEO Group.

It was recently revamped for use as an immigration detention facility.

The incident occurs amid ongoing tension, with activists calling for access and the city raising concerns about the facility’s certificate of occupancy, a claim the GEO Group disputes.

Following recent protests, large barricades have been placed around the facility’s entrance.

The legal process is now underway regarding the serious charges filed against the Congresswoman.
